PORTLAND, Ore. (December 28, 2017) — An appellate court Thursday upheld a penalty against Oregon bakery owners who refused to make a cake for a same-sex wedding almost five years ago.

The owners of the since-closed Gresham bakery — Aaron and Melissa Klein — argued that state Labor Commissioner Brad Avakian violated state and federal laws by forcing them to pay emotional-distress damages of $135,000 to the lesbian couple.

Their lawyers said Avakian and the state Bureau of Labor and Industries violated the Kleins’ rights as artists to free speech, their rights to religious freedom and their rights as defendants to a due process.

But the Oregon Court of Appeals sided with the state Thursday, saying the Kleins failed to show the state targeted them for their religious beliefs.

Emotional-distress damages? 

Nice bakery you got there. Be a shame if something happened to it. Now make me a cake.

The decision comes weeks after the U.S. Supreme Court heard arguments in the high-profile case of a Colorado baker who refused to make a wedding cake for a same-sex couple.

That baker, Jack Phillips, claims his First Amendment claims of artistic freedom were being violated — a similar issue raised by the Kleins.

    If the supreme court finds that you can’t force a baker to sell you a cake, how many of the parties involved would the bakeries have the right to sue? The loss of a business is generally not considered a small matter in the courts.

      I suspect that the loss of the business will be considered a side-effect of the ongoing litigation.

      The process is the punishment, you know.

      These sort of perverts don’t want cakes. What they want is for society to recognize their perversions as “normal” and even that won’t make them happy. They expect (and demand) that they be cherished as special snowflakes because they are fucked in the heads to the point where they can’t grasp that Tab A goes into Slot B, and HEY! You can have kids without resorting to a turkey baster, and maybe the little fuckers won’t grow up fucked in the head because of Mommy and Mommy or Daddy and Daddy.

      I firmly believe that the poofers and rug-munchers have every right to live their lives as they see fit, whether or not others think their lifestyle is immoral and revolting. The way to deal with them is via malicious compliance. Their mistake was being truthful about their beliefs rather than just quoting a ridiculous price, or sub-contracting the job out and tacking on a ridiculous mark-up.

      I hope these people enjoy it when various forms of prejudice fester and proliferate in secret, rather than dumbasses like neo-Nazis and KKKers being exposed to public ridicule.

      When these snowflakes go to an Islamic baker and demand he make them some vagina snickerdoodles I’ll applaud them for their integrity… and applaud even louder when they get the Theo van Gogh treatment! (Not holding my breath!)

  5. I’d have just baked a shitty cake and made sure it was ugly as well, for the usual price. I’m mentally unable to sustain religious beliefs, though, so I can’t really put myself in the Kleins’ place in a valid way.
